In Ukraine, during the general mobilization, conscripted citizens may receive summonses. The TCC and SP can summon individuals for several reasons.

According to the current regulations, the delivery of summonses to conscripts and reservists must occur in accordance with Article 22 of the Law of Ukraine "On Mobilization Preparation" and Cabinet of Ministers Resolution No. 560. Reports the NV portal.

A properly formatted summons is delivered personally with a signature or sent by mail. If the document is received improperly, it can be contested. Failure to appear without a valid reason may result in administrative or criminal liability.

Consequences of ignoring a summons:

  • The first and second failure to appear for data clarification results in an administrative fine.
  • The third failure to appear may lead to criminal prosecution.

At the same time, citizens who have valid reasons for not appearing are exempt from liability, including:

  • death of a close relative;
  • hospitalization;
  • natural disaster;
  • combat actions in the place of residence;
  • other circumstances preventing personal appearance.

All these incidents must be documented.

Reasons for being declared wanted

For violating military registration rules, an individual may be assigned the status of "wanted" in the "Oberih" or "Reserve+" registries. This applies in the following cases:

  • failure to register for military service after the age of 18;
  • disregarding military registration by women with medical or pharmaceutical education;
  • failure to renew registration data after being removed from the register;
  • residing outside the registered address without notifying the TCC;
  • failure to appear for a summons without valid reasons;
  • refusal to undergo a military medical commission (VMC);
  • evading mobilization summons.

Being declared wanted can occur for two reasons:

  1. Committing a criminal offense under Articles 335-337 of the Criminal Code of Ukraine (evasion of mobilization and military registration).
  2. Committing an administrative offense under Articles 210-210-1 of the Code of Ukraine on Administrative Offenses.

How a person is declared wanted

The process of declaring a person wanted involves several stages:

  • Identification by the TCC of the evasion fact.
  • Sending a notification to the National Police.
  • Initiating a pre-trial investigation.
  • Entering data into the Unified Register of Pre-Trial Investigations (URPI).
  • Notifying the individual of the suspicion.
  • The investigator or prosecutor makes a decision to declare the individual wanted.
  • Entering information into the Ministry of Internal Affairs database.

Can TCC employees detain citizens?

According to Ukrainian law, TCC representatives do not have the authority to detain citizens. They can check documents and issue summonses, but only law enforcement agencies can forcibly detain individuals.

Administrative detention is only possible under three conditions:

  • legal grounds (e.g., committing an administrative offense);
  • authority of the relevant bodies (police, SBU, State Border Guard Service);
  • the creation of an official detention protocol.

Thus, citizens should carefully adhere to legal requirements and timely update their registration data with the TCC to avoid legal consequences.
